By accessing or using our services, you ("User") agree to be bound by these Terms. If you do not agree, you may not use our services. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or prominent website notice.

You must be at least 18 years of age. When registering, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately at info@makeea.com of any unauthorized access. We are not liable for losses from credential compromise due to your actions. We may suspend or terminate accounts that violate these Terms, provide false information, or engage in fraud.

VinaBot provides: • AI-powered Expert Advisor (EA) generation for MetaTrader 4 (MT4) and MetaTrader 5 (MT5) • Pre-built trading bots: Superbot, VNB-SS650 3.0 • Backtest tools and Trust-Seal performance verification • Technical indicator library • VPS setup guidance and technical support Our services are technical tools only. We do NOT provide financial advisory, portfolio management, or brokerage services. We are not licensed as a financial institution or investment adviser.

All content, software, algorithms, and designs on our platform are owned by or licensed to VinaBot, protected under Vietnamese IP Law (No. 50/2005/QH11, amended 2022) and international copyright conventions. You may not reproduce, distribute, modify, or create derivative works without express written consent. AI Output Ownership: You own EA files generated for you, excluding VinaBot's underlying algorithms and platform code. Output is for personal use only — resale or commercial redistribution is prohibited without written permission.

You agree to use our services for lawful purposes only. Prohibited actions include: • Illegal use or violation of Vietnam's Cybersecurity Law 2018 • Unauthorized access to our systems or databases • Transmitting viruses or harmful code • Reverse engineering or decompiling our software • Reselling or sublicensing services without authorization • Using the platform to manipulate financial markets • Impersonating VinaBot, staff, or other users • Submitting false or misleading information • Using automated tools (bots, scrapers) beyond normal use

They: • Do not constitute financial or investment advice • Do not guarantee profits • Are built on historical data and do not guarantee future performance By using our services, you acknowledge full personal responsibility for all trading decisions. VinaBot is NOT registered as an investment adviser with any regulatory authority. VINABOT'S PRODUCT IS PURELY COMPUTER SOFTWARE. NO FEATURE, ALGORITHM, SOURCE CODE, EA, BACKTEST, SIGNAL, OR OUTPUT CONSTITUTES, OR SHALL BE CONSTRUED AS, INVESTMENT ADVICE, FINANCIAL ADVICE, A BUY/SELL RECOMMENDATION, OR A SOLICITATION TO TRADE OF ANY KIND.

VinaBot's tools generate source code automatically from your input ideas. Because this process is automated and probabilistic, the User bears a MANDATORY OBLIGATION to independently test all generated source code, Expert Advisors (EAs), and bots before deploying them with real capital. The minimum required testing process includes: • Reading, reviewing, and verifying the complete logic of the generated source code — including but not limited to entry logic, exit logic, Stop Loss, Take Profit, and money management; • Running full Backtests on representative historical data; • Rigorously testing on a DEMO ACCOUNT for a period sufficient to evaluate the bot's behaviour across varied market conditions, BEFORE deploying on a REAL (live) account. THE USER ACKNOWLEDGES AND AGREES THAT AUTOMATICALLY GENERATED CODE MAY NOT FULLY REFLECT THE USER'S ORIGINAL INTENT, MAY OMIT OR CONTAIN UNINTENDED LOGIC (INCLUDING THE ABSENCE OF A STOP LOSS), AND THAT DETECTING SUCH DISCREPANCIES DURING THE TESTING PHASE IS THE SOLE RESPONSIBILITY OF THE USER. ANY DAMAGE, LOSS, OR ACCOUNT BLOW-UP ARISING FROM THE USER'S FAILURE TO PERFORM, OR INCOMPLETE PERFORMANCE OF, DEMO-ACCOUNT TESTING SHALL BE DEEMED ENTIRELY THE RESULT OF THE USER'S OWN CONTRIBUTORY NEGLIGENCE, AND VINABOT SHALL BE FULLY RELEASED FROM ALL RELATED LIABILITY.

THE SERVICES, SOFTWARE, CODE-GENERATION TOOLS, EAs, AND ALL CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, VinaBot disclaims all implied warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. VINABOT DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, FREE OF BUGS, FULLY SECURE, OR ABSOLUTELY SUITABLE FOR ANY SPECIFIC STRATEGY, PROFIT TARGET, OR EXPECTATION OF THE USER. The User acknowledges that AI code-generation software is experimental and probabilistic in nature, that its output may vary, be imperfect or incomplete, and the User accepts all risks arising from its use.

Payments: All fees are as displayed on our website. We accept bank transfers, e-wallets, and listed payment methods. Refund Policy: Refunds are available within 7 (seven) days of first purchase if unsatisfied, provided: • Request submitted to info@makeea.com within 7 days of purchase • Applies to initial purchases only, not renewals • One-time bot orders are non-refundable once the EA file has been delivered This policy complies with Vietnam's Consumer Protection Law 2023 (No. 19/2023/QH15).

To the maximum extent permitted by applicable law (Vietnamese Civil Code 2015 — No. 91/2015/QH13): VINABOT — TOGETHER WITH ITS OWNERS, MEMBERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS — SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to: • Loss of profits, revenue, or anticipated trading opportunity; • Decline in trading account balance (Drawdown), trading losses, or account blow-up; • Damage caused by software errors, logic errors, a missing Stop Loss, or output that does not meet expectations; • Damage caused by service interruption, server/VPS disconnection, execution latency, Slippage, requotes, or partial fills; • Damage caused by the acts, errors, or failures of third-party brokers, exchanges, data providers, or VPS providers. THE FOREGOING EXCLUSIONS APPLY EVEN IF VINABOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF THE PLATFORM IS PROVEN TO HAVE A TECHNICAL FAULT. LIABILITY CAP: IN ANY EVENT, VINABOT'S TOTAL AGGREGATE LIABILITY TO THE USER SHALL NOT EXCEED THE ACTUAL AMOUNT THE USER PAID TO VINABOT FOR THE SOFTWARE, CODE GENERATION, OR SUBSCRIPTION FEES IN THE MONTH IN WHICH THE EVENT GIVING RISE TO THE CLAIM OCCURRED. This clause does not exclude liability for fraud, wilful misconduct, or any liability that cannot be excluded under mandatory Vietnamese law. Some jurisdictions do not allow the exclusion of certain warranties or limitations; in such cases VinaBot's liability is limited to the minimum extent permitted by law.

These Terms are governed by the laws of the Socialist Republic of Vietnam. For Vietnamese users: disputes shall be resolved through negotiation first. If unresolved within 30 days, disputes go to competent Vietnamese courts or VIAC (Vietnam International Arbitration Centre). For international users: disputes may be resolved through UNCITRAL arbitration, seat in Hanoi, Vietnam. Vietnamese consumers may also file complaints with the Vietnam Competition and Consumer Authority (VCCA) under Decree 98/2020/ND-CP.

Your use of our services is subject to our Privacy Policy at vinabot.vn/privacy. We process personal data in compliance with Vietnam's Decree 13/2023/ND-CP on Personal Data Protection and the EU GDPR where applicable.

We may terminate or suspend your account immediately if you violate these Terms or engage in conduct harmful to our services or users. Upon termination: your right to use services ceases immediately; data may be deleted per our Privacy Policy. You may delete your account at any time by contacting info@makeea.com.
